Terms of use

This English version is a convenience translation. Only the German version is legally binding. German version (binding)

1. Provider and scope

EmbedAvatar is provided by Fabian Wagenfeld (address and contact in the imprint) (“we”). These terms apply to the use of embedavatar.com. EmbedAvatar is a private, non-commercial project. Use is free of charge; there are no paid services.

2. Service

EmbedAvatar lets you create an animated avatar from your own images and embed it as an overlay in streaming software (e.g. OBS).

We strive for reliable operation, but as a free service we cannot promise any particular availability. We may change or restrict features or discontinue the service. We will announce a discontinuation by email at least four weeks in advance so you can export your data.

3. Account

  • You must be at least 16 years old.
  • Provide an email address that belongs to you and keep your credentials secret.
  • An account is for one person. You are responsible for activity in your account to the extent you are at fault.

4. Your content

You keep all rights to your images. So that we can provide the service, you grant us the simple, free-of-charge right to store your content, process it technically (e.g. scale it down and re-encode it) and deliver it via your overlay links. This right ends when you delete the content or your account.

Uploaded images can be accessed by anyone who knows the overlay link or the image address.

Only upload content for which you hold the necessary rights. In particular, content is prohibited that

  • violates applicable law (e.g. incitement to hatred, depictions of sexual abuse, prohibited symbols, glorification of violence),
  • infringes the rights of others (copyright, trademark or personality rights, e.g. images of other people without their consent),
  • is pornographic or harmful to minors,
  • contains malware or attacks the service.

You may not overload the service with automated requests, circumvent security measures or use other people's accounts.

5. Reports, suspensions and complaints

Anyone can report illegal content via the report form or to mccurlygames@gmail.com. We review reports promptly and carefully.

If content violates these terms or applicable law, we may disable the overlay concerned, remove content and, in serious or repeated cases, suspend your account. We inform you of such a measure and the reasons for it (Art. 17 DSA) where legally permitted. You can object within six months by email to mccurlygames@gmail.com; we will then review the decision again.

6. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act. Otherwise – since the service is free of charge – our liability is excluded to the extent permitted by law. Please keep your own copies of your images.

7. Term and termination

You can delete your account yourself at any time in the account settings. We can end your use with two weeks' notice by email, or without notice in the case of serious violations.

8. Changes to these terms

We may change these terms, for example if the service or the law changes. We will inform you of changes by email at least four weeks in advance. If you don't agree, you can delete your account before then.

9. Final provisions

German law applies. Mandatory consumer protection provisions of the country in which you habitually reside remain unaffected. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
